Assess whether a UAE free zone business can qualify for the 0% Corporate Tax rate on Qualifying Income and build the compliance framework needed to preserve it.
The phrase '0% free zone tax' is one of the most misunderstood propositions in the modern UAE. The corporate-tax regime does preserve a 0% rate for the Qualifying Income of a Qualifying Free Zone Person, but the status is conditional and the analysis depends on what the company earns, who it transacts with, what activities it conducts and whether it maintains the required substance and compliance.
For an established free zone business, this is not an academic tax classification. A company that builds its pricing, mainland sales or group arrangements around an assumed 0% rate can face a very different outcome if it fails the qualifying conditions.
FTA guidance identifies core conditions including maintaining adequate substance in the UAE, deriving Qualifying Income, complying with transfer-pricing rules and maintaining the required documentation, and not electing into the ordinary corporate-tax regime.
The company must therefore be reviewed as a business rather than by looking at its licence. People, assets, activities, customers and related parties can all affect the analysis.
The rules distinguish qualifying and excluded activities and contain specific treatment for transactions with other free zone persons, mainland persons and overseas counterparties. The nature of the income stream matters.
A business with several revenue lines may therefore need to map them individually rather than apply one tax rate to the company as a whole. Contracts and invoicing should support the classification used in the tax position.
The FTA's corporate-tax legislation library includes Decision No. 6 of 2026 addressing additional procedures for Qualifying Free Zone Person compliance. This reinforces the need to work from current rules rather than the assumptions used when corporate tax was first introduced.
Transfer pricing, audited financial statements where required, de minimis rules and substance should form part of the annual compliance calendar rather than being checked only when the return is due.
We map the entity, zone, activities, customers, related parties, income streams, people and assets, then coordinate the technical analysis with qualified UAE tax advisers.
Any gaps in substance, documentation, contracts or transaction classification are identified before filing. The objective is not to promise 0% tax, but to determine whether the company qualifies and what it must continue doing to preserve that treatment.
