Assess US state sales-tax nexus across physical and economic activity and coordinate registration and compliance where required.
US sales tax is not a federal VAT. It is a state and local system in which registration, taxability, rates and filing obligations can change according to where customers, employees, inventory and sales are located. For an international e-commerce or services business, that fragmentation is often the most surprising part of entering the US market.
Since the expansion of economic-nexus rules, a company can create sales-tax obligations in a state without opening an office there. Physical presence still matters, but revenue and transaction thresholds can independently bring a remote seller into a state's registration regime.
Employees, offices, inventory and other physical presence can create nexus, while economic-nexus rules apply their own sales or transaction tests. Marketplace sales can also interact with facilitator collection rules.
The company should therefore build a state-by-state sales profile rather than assume that one national turnover threshold determines its obligations.
A state may tax tangible goods, digital products, software or particular services differently from another state. Establishing nexus does not answer whether the company's actual product is taxable.
Product and service classification should therefore be documented before registrations multiply. Incorrectly charging tax can be as problematic commercially as failing to collect it.
Once registered, the business needs processes for rates, exemptions, returns, remittance and customer documentation. Filing frequency can change as sales grow.
The accounting and commerce systems should capture customer location and taxable sales accurately enough to support those returns rather than relying on manual reconstruction.
We map physical presence, state sales, marketplaces and product/service categories, then coordinate nexus and taxability analysis with qualified state-tax specialists.
Registrations and filing processes are implemented only where required. The objective is to make multi-state indirect tax a controlled operational process rather than an unexpected consequence of US growth. For e-commerce businesses, marketplace facilitator laws can shift collection responsibility to platforms for particular sales, but they do not necessarily eliminate the seller's registration or filing analysis for all channels. Direct website sales, wholesale activity and marketplace transactions should therefore be separated in the data. Exemption certificates and resale documentation also need disciplined retention where relevant, because the absence of customer evidence can turn an otherwise exempt transaction into an audit exposure.
