Accounting, Tax & Employer Services
Assess whether particular Hong Kong company profits may be offshore-sourced and prepare the factual evidence needed to support the position.
Hong Kong's territorial tax system can produce a legitimate offshore profits position where the operations that generate the relevant profits take place outside Hong Kong. It is not, however, an automatic exemption for companies with overseas customers or foreign bank receipts.
The analysis is transactional and factual. Where contracts are negotiated, services are performed, purchasing decisions are made and sales are concluded can matter more than the customer's address or the place where money is received.
IRD's source principles focus on the operations that produce the profits and where those operations take place. Different types of income can require different source analyses.
A trading company and a consultancy should therefore not use the same offshore narrative simply because both sell to overseas customers.
Contracts, emails, travel, staff responsibilities, order flows and service-delivery records can support where key operations occurred. Reconstructing those facts years later is much harder than maintaining them contemporaneously.
The company's governance and accounting records should tell the same story as the offshore claim.
Hong Kong's foreign-sourced income exemption regime introduced additional rules for specified foreign-sourced income received in Hong Kong by MNE entities. The offshore source analysis should therefore be coordinated with the FSIE framework where relevant.
Economic substance, participation and nexus conditions can change the outcome for particular income categories.
Coutts Consultants maps the profit streams and the operations producing them, then coordinates source analysis and evidence preparation with qualified Hong Kong tax professionals.
The objective is to claim offshore treatment only where the facts support it and to maintain records capable of explaining that position to the IRD. For trading businesses, the review should distinguish where purchase and sale contracts are effected and what the Hong Kong team actually does; for service businesses, the place where the income-producing services are performed can become central. The evidence model should therefore follow the particular profit type rather than rely on a standard offshore checklist.
Coutts Consultants coordinates Hong Kong offshore-profit fact gathering and evidence preparation around actual profit-producing operations, with technical source conclusions handled by qualified tax advisers.
