Trusts, Foundations & Private Wealth
Coordinate an ADGM foundation with governance, charter, council and applicable company service provider requirements reviewed.
An ADGM foundation has separate legal personality and can serve defined succession or asset-holding purposes. It differs from a DIFC foundation, a trust and a company with shareholders.
We coordinate founder objectives and instructions to ADGM legal and administration professionals. The review covers the charter, by-laws, council and guardian requirements, together with any relevant company service provider obligation or exemption. Registration and transferring assets into the foundation are separate steps.
Provide founder and intended beneficiary details, assets, source of wealth, existing arrangements and tax connections. Confirm powers, provider acceptance and ongoing reporting. Tax, foreign asset recognition, creditor issues, valuation and implementation require separate professional assessment; protection or tax results are not automatic.
Coutts Consultants coordinates the planning documents and appropriately licensed trustee, administrator or legal adviser. The engagement identifies establishment, ongoing administration and external professional fees separately. Tax outcomes depend on the parties and assets involved; no confidentiality, creditor-protection or tax result is automatic.
